These Terms and Conditions ("Terms") govern your use of the LuxAtolls website (luxatolls.com) and any bookings made through our platform. By accessing our website or making a booking, you agree to be bound by these Terms. Please read them carefully before proceeding.

1. About LuxAtolls

LuxAtolls provides independent Maldives resort comparison, editorial content, and a booking service that connects travellers with resort operators and third-party travel service providers. When you make a booking through LuxAtolls, we act as an intermediary agent on your behalf. The contract for your travel arrangements is between you and the relevant service provider(s).

2. Use of This Website

By using this website, you warrant that:

  • You are at least 18 years of age and have the legal capacity to enter into binding agreements
  • All information you provide is accurate, complete, and current
  • You are responsible for maintaining the confidentiality of any account credentials
  • You will use this website only for legitimate personal travel planning and booking purposes

3. Agency and Third-Party Providers

LuxAtolls acts as an agent for third-party travel service providers, including but not limited to resort operators, transfer services, airlines, and excursion companies. We exercise care in selecting reputable service providers, but we have no control over, and accept no liability for, the products and services provided by third parties.

Each service provider operates under its own terms and conditions, which may include specific policies on cancellation, liability, and insurance requirements. It is your responsibility to review and comply with those terms.

4. Prohibited Activities

When using our website, you agree not to:

  • Use the site for any commercial purpose without our written consent
  • Impersonate any person or entity, or misrepresent your affiliation
  • Interfere with or disrupt the website's functionality, security, or servers
  • Make fraudulent or speculative bookings or enquiries
  • Copy, reproduce, distribute, or republish any content from this website without prior written permission
  • Use automated tools, bots, or scrapers to extract data from our website

5. Intellectual Property

All content on this website — including text, images, photography, graphics, logos, layout, and design — is the property of LuxAtolls or its licensors and is protected by applicable intellectual property laws. You may not reproduce, modify, distribute, or republish any content without our prior written consent.

6. Fares, Pricing, and Payment

Resort prices, package rates, transfer costs, and airfares displayed on our website are provided for comparison and informational purposes. All prices are subject to change without notice based on availability, currency fluctuations, seasonal adjustments, supplier updates, and changes in government taxes or levies.

Price validity: Quoted prices are held for 3 days from the date of your quote, unless otherwise stated. After this period, prices may be requoted at the prevailing rate. A fare or rate is only guaranteed once full payment has been received and written confirmation issued by LuxAtolls.

Payment: Your credit card or nominated payment method will be charged at the time of booking confirmation. All payments are processed in the currency specified on your invoice. LuxAtolls reserves the right to pass on any price increases imposed by suppliers between the date of your quote and the date of full payment, where the increase is beyond our control.

Taxes and surcharges: Prices may be subject to resort service charges, Green Tax (Maldives government environmental levy), Goods and Services Tax (GST), and other applicable government-imposed fees. These are included in your quoted price where known at the time of booking, but may be adjusted if changed by the relevant authority prior to your departure.

7. Bank Fees, Credit Card Surcharges, and Currency Conversion

LuxAtolls is not responsible for any fees, charges, or exchange rate differences imposed by your bank, credit card provider, or financial institution when processing your payment. These may include but are not limited to:

  • International transaction fees or cross-border payment surcharges
  • Currency conversion fees and exchange rate margins applied by your bank or card issuer
  • Cash advance fees if your card issuer treats travel payments as a cash advance
  • Dynamic currency conversion charges applied at the point of sale

You are responsible for confirming any applicable fees with your financial institution prior to making a booking. Differences between the exchange rate at the time of booking and the rate at the time of settlement are your responsibility. LuxAtolls will not issue refunds or adjustments for currency fluctuations or bank-imposed fees.

8. Booking Confirmation

A booking is confirmed only when you have received written confirmation from LuxAtolls (typically via email) and any required deposit or full payment has been processed. Verbal or email enquiries do not constitute a confirmed booking.

You are responsible for reviewing all booking confirmation documents carefully upon receipt. If there are any errors or discrepancies in names, dates, resort selection, villa category, transfer type, or any other detail, you must notify LuxAtolls within 48 hours of receiving your confirmation. Corrections requested after this period may be treated as amendments and may incur additional fees.

9. Booking Amendments

If you wish to make changes to a confirmed booking (including date changes, room upgrades or downgrades, name corrections, or changes to transfer arrangements), the following terms apply:

  • An amendment fee of USD $20 per booking applies for each amendment request, in addition to any fees or rate differences charged by the relevant service provider
  • Amendments are subject to availability and cannot be guaranteed
  • If the amendment results in a higher fare or rate, you will be required to pay the difference before the change is confirmed
  • If the amendment results in a lower fare or rate, the difference may not be refundable depending on the supplier's policies
  • Amendments requested within 14 days of departure may incur a late-change surcharge and are processed on a best-efforts basis
  • Name changes after ticketing or booking confirmation may be treated as a cancellation and rebooking, subject to cancellation fees

Some bookings — particularly those made under promotional, discounted, or non-refundable rates — may not be eligible for amendment. In such cases, you may need to cancel the existing booking and rebook at the prevailing rate.

10. Cancellation Policy

If you need to cancel a confirmed booking, the following cancellation fees apply based on the number of days before your scheduled departure date:

  • 45+ days before departure: Loss of deposit (USD $200 per person, or as specified on your booking confirmation)
  • 44 to 31 days before departure: 50% of total booking cost, or loss of deposit (whichever is greater)
  • 30 days or fewer before departure: 100% of total booking cost

Deposits are non-refundable and cannot be transferred to other bookings. No refunds will be issued after travel has commenced, including for unused portions of your trip (such as early check-out, missed transfers, or skipped excursions).

Cancellation requests must be submitted in writing to reservations@luxatolls.com. The date of cancellation is the date on which written notice is received by LuxAtolls, not the date on which you sent your request. We strongly recommend obtaining comprehensive travel insurance that includes trip cancellation coverage.

11. Changes to Pricing and Itineraries

While LuxAtolls makes every effort to ensure that prices, availability, and itineraries are accurate at the time of booking, circumstances may arise that require changes. You acknowledge and agree that:

  • Resort operators and service providers may alter rates, room availability, meal plan inclusions, or package components at any time prior to your arrival
  • Transfer schedules (including seaplane, domestic flight, and speedboat departure times) are subject to change by the operator due to weather, tides, maintenance, or operational requirements
  • LuxAtolls reserves the right to pass on any price increases imposed by suppliers, governments, or regulatory authorities after your booking has been confirmed but before final payment is received
  • If a material change to your itinerary or pricing is required after full payment, LuxAtolls will notify you as soon as practicable and offer you the choice of accepting the change, selecting an alternative arrangement of comparable value, or cancelling with a full refund of amounts paid (less any non-recoverable third-party costs)

Minor changes to transfer times, villa allocation within the same category, or meal service schedules do not constitute a material change and are not grounds for cancellation or refund.

12. Promotional and Special Offers

From time to time, LuxAtolls may advertise promotional rates, hot deals, early-bird offers, honeymoon packages, or other special pricing. These offers are subject to the following conditions:

  • Promotional rates are available for a limited time only and are subject to availability at the time of booking
  • Special offers cannot be combined with other discounts, loyalty programmes, or negotiated rates unless explicitly stated
  • Promotional bookings may carry stricter cancellation and amendment policies than standard bookings, including non-refundable and non-transferable conditions
  • LuxAtolls reserves the right to withdraw, modify, or extend any promotional offer at any time without prior notice
  • If a promotional rate is no longer available at the time your booking is processed, you will be notified and offered the current best available rate

Offers displayed on our website are indicative and based on information provided by resort operators. LuxAtolls does not guarantee that the specific offer, room type, or inclusions shown will be available for your requested dates.

13. Supplier Rules, Conditions, and Penalties

When you book travel services through LuxAtolls, you are also bound by the terms, conditions, and rules of each individual service provider involved in your trip. These may include, but are not limited to:

  • Resort operators: Check-in and check-out times, dress codes, damage deposits, smoking policies, minimum stay requirements, child policies, and all-inclusive usage rules
  • Transfer operators: Luggage weight and size restrictions (particularly for seaplane transfers, which typically impose a 20–25 kg limit per person including carry-on), prohibited items, check-in requirements, and no-show policies
  • Airlines: Baggage allowances, check-in deadlines, dangerous goods restrictions, fare rules, change and cancellation fees, and conditions of carriage
  • Excursion and activity providers: Age and health requirements, signed waivers, minimum participant numbers, weather-related cancellations, and liability disclaimers

Failure to comply with any supplier's rules may result in denied service, cancellation without refund, or additional charges. LuxAtolls is not liable for any penalties, losses, or expenses you incur as a result of non-compliance with supplier rules.

Suppliers may also impose their own cancellation penalties that differ from, and may be more restrictive than, the LuxAtolls cancellation policy outlined in these Terms. Where a supplier's cancellation policy results in higher fees, the supplier's policy will prevail.

14. Frequent Flyer and Loyalty Programmes

If you wish to earn frequent flyer miles, airline loyalty points, or hotel loyalty credits for services booked through LuxAtolls, please note the following:

  • Enrolment in any frequent flyer or loyalty programme is your sole responsibility. You must provide your membership number at the time of booking or directly to the service provider
  • LuxAtolls does not guarantee that bookings made through our platform will be eligible for loyalty programme accrual, as eligibility is determined by the airline, hotel, or programme operator
  • Certain fare classes, promotional rates, or package bookings may not qualify for mileage or points accrual
  • LuxAtolls is not responsible for any failure to credit miles, points, or loyalty benefits, and cannot intervene in disputes between you and a loyalty programme operator

15. Travel Insurance

We strongly recommend that you obtain comprehensive travel insurance before departure. Your policy should cover, at minimum:

  • Trip cancellation and trip interruption
  • Medical expenses, hospitalisation, and dental emergencies
  • Emergency evacuation and repatriation (including air ambulance from remote atolls)
  • Loss, theft, or damage to luggage and personal belongings
  • Travel delays, missed connections, and flight cancellations
  • Personal liability and legal expenses

LuxAtolls is not liable for any losses, expenses, or claims arising from inadequate or absent insurance coverage. Travel to the Maldives involves travel to remote island locations where medical facilities may be limited, and emergency evacuation by air ambulance can be extremely costly. You are advised to confirm that your policy provides adequate coverage for the specific nature of your trip.

If you choose to travel without insurance, you do so entirely at your own risk and accept full financial responsibility for any costs that would otherwise have been covered by an insurance policy.

16. Passports, Visas, and Entry Requirements

It is your sole responsibility to ensure that you hold valid travel documentation for every leg of your journey, including any transit countries. Requirements include but are not limited to:

  • Passport validity: Your passport must be valid for at least six (6) months from the date of entry into the Maldives. Some transit countries may impose their own validity requirements
  • Visa requirements: Most nationalities receive a free 30-day tourist visa on arrival in the Maldives, subject to holding a confirmed hotel booking, proof of sufficient funds, and a return or onward ticket. However, requirements vary by nationality and can change without notice. You must verify the specific requirements for your passport before travel
  • Transit visas: If your journey involves a stopover or transit through another country (e.g., Sri Lanka, Singapore, Dubai, India), you may require a separate transit visa. It is your responsibility to check and obtain any necessary transit visas
  • Name matching: The name on your booking must exactly match the name on your passport as it appears in the machine-readable zone. Any discrepancy may result in denied boarding or entry refusal
  • Dual nationals: If you hold more than one passport, you must ensure that you travel on the same passport used for your booking and airline ticket

LuxAtolls accepts no liability for denied boarding, entry refusal, deportation, detention, or any other consequences arising from incorrect, insufficient, or expired travel documentation. Any costs incurred as a result (including rebooking fees, accommodation, or repatriation) are your sole responsibility.

17. Travel Documents and Vouchers

Upon confirmation and receipt of full payment, LuxAtolls will issue your travel documents, which may include booking confirmations, resort vouchers, transfer vouchers, and detailed itinerary information. Please note:

  • All travel documents are issued electronically via email to the address provided at the time of booking
  • You must carry printed or digital copies of all vouchers and confirmations for presentation upon arrival at the resort and to transfer operators
  • It is your responsibility to check all documents for accuracy immediately upon receipt. Any errors must be reported to LuxAtolls within 48 hours
  • Lost or misplaced vouchers should be reported to LuxAtolls as soon as possible. We will endeavour to reissue them, but cannot guarantee acceptance by suppliers without original documentation
  • Travel documents are non-transferable and are valid only for the named traveller(s) and dates specified

18. Travel Advice and Warnings

You are responsible for staying informed about current travel conditions, health advisories, and safety warnings for the Maldives and any transit countries. We recommend that you:

  • Check your government's official travel advisory website before booking and again before departure (e.g., DFAT Smartraveller for Australian citizens, FCDO for UK citizens, US State Department for US citizens)
  • Register your travel plans with your government's consular assistance programme where available
  • Monitor any health advisories, vaccination requirements, or quarantine regulations that may apply to the Maldives or your transit points
  • Be aware that the Maldives is a Muslim country with local laws and customs that may differ significantly from your home country, including restrictions on alcohol (permitted only within resort islands), modest dress expectations on inhabited islands, and importation restrictions on certain items (including alcohol, pork products, religious materials contrary to Islam, and drone equipment)

LuxAtolls makes no representations about the safety, suitability, or advisability of travel to any particular destination. If your government issues a travel warning or advisory against travel to the Maldives (or a relevant transit country) after you have made a booking, the standard cancellation policy applies unless the situation qualifies as a force majeure event at our reasonable discretion.

LuxAtolls shall not be held liable for any loss, injury, expense, or inconvenience arising from your failure to heed official travel warnings or to comply with local laws and regulations.

19. Health and Medical

You are responsible for ensuring that you are medically fit to travel and that you have obtained any required or recommended vaccinations. The Maldives does not currently require specific vaccinations for entry from most countries, but this may change. Consult your doctor or a travel health clinic at least six weeks prior to departure.

Medical facilities in the Maldives are limited, particularly on remote resort islands. Serious medical conditions may require evacuation to Malé or to another country for treatment. You should ensure that your travel insurance includes adequate coverage for emergency medical evacuation, which can cost tens of thousands of dollars.

If you have any pre-existing medical conditions, allergies, dietary requirements, mobility limitations, or special needs that may affect your travel, please advise LuxAtolls at the time of booking so that we can inform the relevant service providers. While we will pass on your requirements, we cannot guarantee that all suppliers will be able to accommodate them.

20. Complaints

If you experience a problem during your trip, you should first raise the issue directly with the service provider (e.g., the resort or transfer operator) to give them the opportunity to resolve it on the spot. If the matter remains unresolved, please notify LuxAtolls in writing within 14 days of your return.

Your complaint should include:

  • Your booking reference number
  • A detailed description of the issue, including dates, times, and the names of any staff involved
  • Any supporting documentation, photographs, or correspondence
  • Details of any steps you took to resolve the issue during your trip

21. Limitation of Liability

LuxAtolls provides its website and services on an "as is" basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, LuxAtolls shall not be liable for:

  • Acts, omissions, defaults, or negligence of third-party service providers, including resort operators, airlines, transfer companies, and excursion operators
  • Flight delays, cancellations, overbookings, or schedule changes by airlines or transfer operators
  • Loss, damage, injury, or expense arising from events beyond our reasonable control (force majeure), including but not limited to natural disasters, severe weather, tsunamis, epidemics or pandemics, government actions, border closures, strikes, civil unrest, or acts of terrorism
  • Any indirect, incidental, consequential, special, or punitive damages arising from your use of our website or services
  • Accuracy of information provided by third-party suppliers, including resort descriptions, photographs, amenity listings, and availability
  • Loss of enjoyment, inconvenience, or disappointment except where caused by our proven negligence

Our total aggregate liability for any claim arising from or in connection with a booking made through LuxAtolls shall not exceed the total amount you paid to us for that booking.

22. Indemnification

You agree to indemnify, defend, and hold harmless LuxAtolls, its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

  • Your breach of these Terms and Conditions
  • Your violation of any applicable law, regulation, or third-party right
  • Your use of our website or services
  • Any dispute between you and a third-party service provider
  • Any claim by a third party arising from your actions or omissions during your trip

23. Third-Party Links

Our website may contain links to third-party websites for your convenience and information. LuxAtolls does not endorse, control, or accept responsibility for the content, accuracy, privacy practices, or security of external websites. Visiting third-party sites is at your own risk, and you should review their terms and privacy policies independently.

24. Your Responsibilities

By making a booking through LuxAtolls, you confirm that:

  1. You are 18 years of age or older and authorised to make the booking on behalf of all travellers named
  2. You have sufficient funds or credit available to cover the full cost of your travel arrangements
  3. You have read, understood, and agree to be bound by these Terms and Conditions
  4. You have communicated the material terms of these Terms and Conditions to all travellers included in your booking, and that they have consented to be bound by them
  5. You will check all booking documents, confirmations, and vouchers for accuracy within 48 hours of receipt and notify us immediately of any errors
  6. You will reconfirm flights directly with the airline at least 72 hours before each scheduled departure
  7. You will obtain comprehensive travel insurance before departure that covers all travellers on the booking
  8. You are responsible for holding valid passports, visas, and all required travel documentation for every country on your itinerary, including transit countries
  9. You will comply with all local laws, customs regulations, and resort rules at your destination
  10. You will arrive at the airport, transfer meeting point, or resort check-in at the times specified in your travel documents

25. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent.

26. Entire Agreement

These Terms and Conditions, together with your booking confirmation, invoice, and any supplementary terms provided at the time of booking, constitute the entire agreement between you and LuxAtolls. No verbal representations, promises, or commitments made by our staff or agents shall be binding unless confirmed in writing.

27. Governing Law

These Terms and Conditions are governed by and construed in accordance with the laws of the relevant jurisdiction. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the appropriate courts.
